Terms of Use & TOYORNOT Plus Subscription Terms

These terms apply to all use of TOYORNOT.com. Section 4 contains the additional terms that apply when you try or buy TOYORNOT Plus.

1. Service Scope

TOYORNOT.com provides an automated graffiti rating, feedback, and practice-lesson service. Depending on the active deployment configuration and your market, the service may also provide Google sign-in, rating history, benchmark displays, share cards, referral or share-based bonus flows, an optional public leaderboard that signed-in users can explicitly post rated pieces to, and a paid TOYORNOT Plus tier. Results are generated automatically and are provided for informational and entertainment purposes only. TOYORNOT Plus changes access conditions, not the inherently automated nature of the results.

2. Accounts and Eligibility

• Certain features require either a browser guest identifier or a signed-in account.
• TOYORNOT Plus checkout requires sign-in with Google so the subscription can be attached to the correct ToyOrNot account.
• Eligible accounts signed in with Google may explicitly start one 3-day TOYORNOT Plus preview. The preview does not require a payment method, does not start automatically at sign-in, and does not convert into a paid subscription unless you complete checkout.
• You must provide only information you are entitled to use and are responsible for keeping access to your sign-in method and device reasonably secure.

3. User Content and Acceptable Use

• Upload only images, screenshots, and other content that you have the right to use and share with us.
• By uploading content, you confirm that you have the rights and permissions needed for the uses described in these Terms and the Privacy Policy, including automated review, service improvement, model training and evaluation, prompt development, and promotional examples.
• Do not upload unlawful, abusive, infringing, deceptive, or privacy-violating material.
• Do not upload private, sensitive, confidential, or personal images unless you have permission from every person whose rights could be affected.
• Use lesson mode for paper, blackbook, owned, permitted, or otherwise legal practice surfaces only. Do not use the service to plan, encourage, or document unauthorized tagging or vandalism.
• Do not attempt to interfere with the service, bypass usage limits, manipulate bonus flows, reverse engineer protected parts of the service, or use automated means to abuse the site.
• If you use optional sharing or referral features, you remain responsible for complying with the rules of the third-party platform you choose to use.
• If you post a rated piece to the optional public leaderboard, only post photos and display names you are allowed to publish. Posting makes the photo, your chosen display name, a country flag, the score, and the rating date publicly visible. Do not use display names that are unlawful, abusive, deceptive, or that impersonate others. You can remove a posted entry by deleting the underlying rating from your history; we may also hide or remove leaderboard entries for moderation, legal, or abuse-prevention reasons.

4. TOYORNOT Plus Subscription Terms

A free TOYORNOT Plus preview is a temporary access window for the signed-in ToyOrNot account. By purchasing TOYORNOT Plus, you enter into a recurring digital-services subscription contract for the signed-in ToyOrNot account used at checkout.

• The Google Plus preview can be used once per eligible account. It is not a subscription, does not require payment details, and does not renew automatically.
• TOYORNOT Plus may remain active during a temporary payment-retry state while Stripe attempts to collect a renewal payment again. If payment is not recovered, access may revert to the free tier.
• Any statutory consumer withdrawal, refund, warranty, or other mandatory rights that apply to you remain unaffected. For EU and UK consumer markets, the checkout summary links market-specific withdrawal information and asks for an explicit immediate-start request before the service begins right away.
• Except where mandatory law requires otherwise or we expressly agree otherwise, canceling TOYORNOT Plus stops future renewals and does not retroactively undo a billing period that has already started.
• We may change TOYORNOT Plus pricing, included features, or legal terms for future billing periods, subject to applicable law. Where notice is required, we will provide it before the affected renewal takes place.

4.1 Withdrawal and Immediate Start

TOYORNOT Plus is offered as a recurring digital service. In EU and UK consumer markets, the order review asks you to request immediate activation after purchase. If you do not want immediate activation, do not complete checkout. This section does not limit any mandatory withdrawal rights that apply to your market.

4.2 Purchase and Cancellation Confirmations

We may send durable billing notices by email, including purchase confirmations, cancellation confirmations, and future notices about fee or terms changes where required or operationally appropriate. If billing-email delivery is not configured or an email cannot be delivered, the on-site cancellation and billing-help routes remain available.

4.3 Fair Use, Suspension, and Trader Cancellation

TOYORNOT Plus is for personal, non-commercial, and non-automated use. We may limit, suspend, or cancel TOYORNOT Plus if it is used in a fraudulent, automated, shared, resold, abusive, or excessively high-volume way that materially harms service stability or creates disproportionate costs. Where reasonable, we may warn first or apply a narrower technical limit instead.

If we end TOYORNOT Plus under this section, we may refund the unused part of the current billing period or the latest TOYORNOT Plus payment. Mandatory consumer rights remain unaffected.

5. Bonus Flows and Automated Review

Bonus flows may require automated checks before credits are granted. Social proof screenshots may be rejected if they are unclear, incomplete, manipulated, duplicated, or do not appear to show a genuine social-media comment or thread view with the relevant ToyOrNot share card. The service does not post to social platforms for you and does not require direct social account integration.

6. Intellectual Property

You retain rights in your uploaded content. By using the service, you grant the operator a worldwide, non-exclusive, royalty-free license to host, process, reproduce, analyze, transform, display, and create derivative technical artifacts from uploaded files, generated results, and related metadata as needed to deliver the requested rating or lesson evaluation, provide history retrieval, prevent abuse, operate the service, improve the product, evaluate and train models, develop prompts and scoring guidance, benchmark quality, and maintain operational records.

You also grant the operator a non-exclusive, royalty-free license to use uploaded images, generated results, share-card-style outputs, and cropped or resized variants for TOYORNOT.com promotional, educational, product-demo, documentation, and marketing examples. We may edit, crop, resize, annotate, combine, or stylize those materials for these purposes. Do not upload content if you are not allowed to grant these rights.

These licenses last as long as needed for the purposes above, including where trained model weights, aggregated quality benchmarks, prompt-evaluation records, cached technical artifacts, public examples, or legal and operational records cannot reasonably be unwound from past use. If you believe uploaded content should not be used for promotional examples, contact the operator using the details in the Impressum or Privacy Policy.

7. Availability and Changes

The service may be modified, paused, or discontinued at any time. Features, processing logic, limits, integrations, supported payment methods, and TOYORNOT Plus benefits may change without prior notice, subject to any mandatory rights that apply to existing paid periods or consumers.

8. Liability

To the extent legally permitted, the service is provided "as is" without guarantees of uninterrupted availability, complete accuracy, or fitness for a particular purpose. Mandatory statutory liability, including under German law, remains unaffected.

9. Governing Law

Unless mandatory consumer law states otherwise, the laws of the Federal Republic of Germany apply.
